Pets in Wills – Public Trust’s helpful webinar
05 October 2026
In July, Public Trust held a webinar to help pet owners start thinking about remembering pets in their Estate Planning and they asked SPCA to be on the panel. The main takeaways from the webinar are below.
Public Trust’s ‘Paws and Provisions’ was part of their Wills Week, an opportunity to encourage people to think about their Wills, consider the legacy they want to leave, and take action. The webinar highlighted a critical gap in Estate Planning; while New Zealanders treat pets like family, few legally protect them. Legal and animal welfare experts warned that failing to formalise pet care arrangements can leave animals highly vulnerable if their owners pass away unexpectedly.
Key takeaways from the webinar
- Pets are property: Under New Zealand law, pets are legally classified as property.
- No direct inheritance: Because of their property status, you cannot leave money or assets directly to an animal.
- The fix: You must legally leave your pet to a specific, trusted Guardian alongside dedicated maintenance funds.
SPCA Board Chair David Broderick was invited to be part of the panel and along with other experts outlined the practical steps owners should take:
- Identify a Guardian: Your “Plan A”. Your Pet Guardian is someone who already knows and is familiar to your pets. Talk to your family and friends and ensure your chosen caretaker is willing and able to take on the responsibility when the time comes.
- Draft a Statement of Wishes: This document accompanies a standard Will to detail everything about your pets – their unique daily routines, dietary needs, medical history, specific favourite treats…
- Set up a legacy plan: For those without an available Guardian, programmes like SPCA’s Pet Legacy Plan offer an alternative safety net; giving you peace of mind and a safe future for your pets. SPCA’s Pet Legacy Plan is “Plan A” for those who don’t have anyone who can be a Guardian for their pets. It’s also a wonderful “Plan B” if “Plan A” doesn’t go according to plan. SPCA’s Pet Legacy Plan is an exclusive, “thank you” to those who have left SPCA a gift in their Will.
